General Terms and Conditions (GTC) / Terms of Use

1. General/Scope

The following general terms and conditions (hereinafter referred to as "GTC") of buyitonline.ch regulate the rights and obligations in the relationship between buyitonline.ch and its customers with regard to all contracts concluded between the parties exclusively in the online shop (pfefferspray.ch).

Deliveries, services and offers from pfefferspray.ch are based exclusively on these General Terms and Conditions. These also apply to all future business relationships, even if they are not expressly agreed again.

Deviations from these terms and conditions are only effective if confirmed by buyitonline.ch and only in writing.

The current and binding version of the GTC is published at www.pfefferspray.ch.

The offer can be seen on the website www.pfefferspray.ch and is non-binding. We reserve the right to make price and assortment changes as well as technical changes. All offers are non-binding and not to be understood as a binding offer. All information on www.pfefferspray.ch (product descriptions, illustrations, films, dimensions, weights, technical specifications, accessory relationships and other information) are only to be understood as approximate values ​​and in particular do not represent any guarantee of properties. All product descriptions, images, photos, text - and media data come from the manufacturers or suppliers or buyitonline.ch and are subject to the sole right of use of buyitonline.ch. buyitonline.ch assumes no liability for the content of external websites and linked partner shops. The offer is primarily aimed at end users. buyitonline.ch therefore reserves the right not to accept customer orders or to shorten them at its own discretion. buyitonline.ch also reserves the right to block customer accounts at its own discretion without giving reasons.

3. Conclusion of contract

The offers of buyitonline.ch on the Internet represent a non-binding invitation to the customer to order goods from buyitonline.ch. On www.pfefferspray.ch, the customer submits a legally binding offer to conclude a contract by sending his order and simultaneously accepting these General Terms and Conditions. The order confirmation then sent automatically by e-mail documents that the customer's order has been received by buyitonline.ch, but does not constitute acceptance of the offer. After receipt of the order confirmation, the customer can no longer cancel or change orders. A contract is only formed when buyitonline.ch declares acceptance, which is sent to the customer by email (acceptance of receipt of order), but no later than when the notification of dispatch is sent. If, after the conclusion of the contract, it turns out that the ordered goods cannot be delivered either in part or in whole for reasons for which buyitonline.ch is not responsible, buyitonline.ch is entitled to withdraw from the contract in whole or in part.

4. Prices

Unless otherwise noted, the price information on www.pfefferspray.ch includes statutory VAT, advance recycling fees (VRG) and copyright fees. The prices are stated net in CHF (Swiss francs).

All prices are only valid within Switzerland. The time of the order is used to determine the price. Prices for products and services are binding on both parties at the time the order is placed on www.pfefferspray.ch in accordance with Section 3. All previous prices and other information about the goods become invalid when the website at www.pfefferspray.ch is updated.

Any shipping costs will be charged additionally and are to be paid by the customer. Shipping costs are shown separately in the ordering process (see also Section 6).

Technical changes, errors and misprints are reserved. buyitonline.ch can make price changes at any time without prior notice. The sales prices do not include any consulting and support services.

5. Payment

For orders we offer the payment methods prepayment, credit card (Visa & Mastercard) and TWINT. We reserve the right to exclude payment on account for new customers. When paying in advance, the outstanding invoice amount is due immediately after conclusion of the contract. The following account is to be used for transfers:

If you pay by credit card, your credit card account will be debited immediately after the order has been completed.
Please note that we only accept payments from accounts within Switzerland. In no case do we assume the costs of a money transaction.
In the case of purchase on account, the purchase price is due for payment on the day the customer receives the delivery and must be transferred to the above account.
If payment is not made within 14 days after the due date, the customer is in default.
If the customer defaults on payment, buyitonline.ch reserves the right to additionally charge the customer for any costs incurred for payment reminders, in particular postage costs, and other damage caused by delay. If the invoice amount owed is not paid after the payment period of the first reminder (10 days) has expired, buyitonline.ch can also charge reminder fees of at least CHF 20.00.

6. Delivery

Deliveries will be made as quickly as possible. If an item is not available, the customer will be informed immediately via e-mail about the expected delivery date. For legal reasons, the delivery can only take place after the age check has been carried out. The delivery period specified in the order only comes into effect after an official ID has been checked. The customer will be informed of the completed check by means of a confirmation e-mail (cf. also section 11).

If the ability to deliver the ordered goods depends on a sub-supplier and if this delivery fails for reasons for which we are not responsible, we are entitled to withdraw from the contract.

The same applies if delivery is made significantly more difficult or impossible due to force majeure or other events and we are not responsible for this.

Such events include in particular: fire, flood, labor disputes, operational disruptions, strikes and official orders that cannot be attributed to our operational risk.

In such cases, the customer will be informed immediately about the lack of delivery options and a service already provided will be refunded immediately.

The customer is not entitled to any further claims.

Partial deliveries are permitted. The resulting additional delivery costs are borne by buyitonline.ch.

7. Returns

Notices of defects or complaints regarding incorrect or incomplete delivered goods must be made in writing within 14 days of the date of dispatch. We will only accept returns if they have been sufficiently stamped. The customer bears the costs for the return. In the case of unstamped returns, we request the postage costs and a flat-rate fee of CHF 20 from the customer.

8. Liability

Other customer claims – regardless of the legal basis – are excluded to the extent permitted by law. buyitonline.ch, its assistants and any vicarious agents are not liable for damage that has not occurred to the goods themselves, in particular not for consequential damage, lost profits or other financial losses of the customer. Liability for damage caused directly or indirectly by the delivered goods (consequential damage) is rejected.

9. Damage in transit

If goods are delivered with obvious damage to the packaging or the contents, the customer must complain immediately to the carrier/parcel service provider and refuse acceptance, without prejudice to his warranty rights. Hidden defects must be reported to the forwarding agent/parcel service provider (e.g. responsible post office) within 24 hours (1 working day) after receipt of the goods. The customer is obliged to have a damage confirmation message from the parcel deliverer (e.g. postal employee) handed over to him. All transport damage must also be reported immediately.

10. Retention of Title

The ordered goods remain the property of buyitonline.ch until full payment has been made. buyitonline.ch is entitled to make a corresponding entry in the retention of title register. Before the transfer of ownership, pledging, transfer of ownership, processing or transformation is not permitted without the express consent of buyitonline.ch.

11. 11 . Chemicals Act / Age of majority / Observance of the safety instructions
    
    Pepper sprays are subject to the Swiss Chemicals Act, which only allows the sale of products to persons who have reached at least 18 years of age . For the delivered products, please always observe the hazard warnings on the packaging or on our website as well as the manufacturer's application and first aid information. If you have any questions, please contact our customer service.

By submitting your order, you affirm that you are at least 18 years old, as required by law, and that your details of your name and address are correct. You are obliged to ensure that only you or persons authorized by you to accept the delivery who have reached the legally prescribed minimum age receive the goods.

12. Privacy

buyitonline.ch points out to the customer that the data recorded as part of the conclusion of the contract is collected, processed and used to fulfill the obligations arising from the purchase contract, and can also be used for marketing purposes. The data required to perform the service can also be passed on to commissioned service partners (logistics partners) or other third parties.

13. Changes and Additions

buyitonline.ch expressly reserves the right to adapt or change these General Terms and Conditions to the circumstances at any time and to apply them immediately.

14. Governing Law and Jurisdiction

In the event of disputes, Swiss substantive law shall apply exclusively, to the exclusion of conflict-of-law norms. The Vienna Sales Convention is explicitly excluded. The place of jurisdiction for natural and legal persons is Ermatingen.
