1. General/Scope

The following General Terms and Conditions (hereinafter referred to as "GTC") of pfefferspray24.ch regulate the rights and obligations in the relationship between pfefferspray24.ch to its customers in relation to all transactions between the parties exclusively in the online shop ( pfefferspray24.ch) concluded contracts.

The deliveries, services and offers of pfefferspray24.ch are carried out exclusively on the basis of these terms and conditions. These therefore also apply to all future business relationships, even if they are not expressly agreed again.

3. Conclusion of contract

4. Prices

All prices are only valid within Switzerland. The price is determined at the time of the order. Prices for products and services are displayed at the time of the order on www. pfefferspray24.ch is binding on both parties in accordance with section 3. By updating the Internet pages at www. pfefferspray24.ch all previous prices and other information about the goods become invalid.

Any shipping costs will be charged additionally and must be paid by the customer. Shipping costs are shown separately in the ordering process (see also section 6).

Technical changes, errors and misprints are reserved. pfefferspray24.ch may change prices at any time without prior notice. The sales prices do not include any consulting or support services.

5th payment

For orders we offer the payment methods prepayment, credit card (Visa & Mastercard) and TWINT. We reserve the right to exclude payment on account for new customers. When paying in advance, the outstanding invoice amount is due immediately after the contract is concluded. The following account should be used for transfers:

If you pay by credit card, your credit card account will be charged immediately after the order is completed.
Please note that we only accept payments from accounts within Switzerland. Under no circumstances do we cover the costs of a money transaction.
When purchasing on account, the purchase price is due for payment on the day the delivery is received by the customer and must be transferred to the account mentioned above.
If payment is not made within 14 days of the due date, the customer will be in default.
If the customer defaults on payment, pfefferspray24.ch reserves the right to charge the customer additional costs for payment reminders, in particular postage costs, and other damages caused by delay. If the invoice amount owed is not paid after the expiry of the payment deadline of the first reminder (10 days), the pfefferspray24.ch will charge additional reminder fees of at least CHF 20.-.

6th delivery

Deliveries are made as quickly as possible. If an item is not available, the customer will be informed immediately by email of the expected delivery date. For legal reasons, delivery can only take place after age verification. The delivery period stated when ordering only takes effect after an official ID has been verified. The customer will be informed of the verification by means of a confirmation email (see also section 11).

If the delivery of the ordered goods depends on a sub-supplier and this delivery fails for reasons for which we are not responsible, we are entitled to withdraw from the contract.

The same applies if delivery becomes significantly more difficult or impossible due to force majeure or other events and we are not responsible for this.

Such events include in particular: fire, flood, industrial action, operational disruptions, strikes and official orders that are not attributable to our operational risk.

In such cases, the customer will be informed immediately about the lack of delivery and any service already provided will be refunded immediately.

The customer is not entitled to any further claims.

Partial deliveries are permitted. Any additional delivery costs resulting from this will be borne by pfefferspray24.ch worn.

7. Returns

Notices of defects or complaints regarding incorrect or incompletely delivered goods must be made in writing within 14 days of the date of dispatch. We will only accept returns if they are sufficiently stamped. The customer will bear the costs of return. In the case of unstamped returns, we will charge the customer the postage costs and a flat-rate fee of CHF 20.-.

8. Liability

Other claims of the customer – regardless of the legal basis – are excluded to the extent permitted by law. pfefferspray24.ch, its assistants and any vicarious agents are not liable for damages that are not caused by the goods themselves, in particular not for consequential damages, lost profits or other financial losses of the customer. Liability for damages that arise directly or indirectly from the goods delivered (consequential damages) is rejected.

9. Transport damage

If goods are delivered with obvious damage to the packaging or contents, the customer must immediately complain to the freight forwarder/parcel service provider and refuse acceptance, without prejudice to his warranty rights. Hidden defects must be reported to the freight forwarder/parcel service provider (e.g. responsible post office) within 24 hours (1 working day) of receipt of the goods. The customer is obliged to obtain a damage confirmation report from the parcel deliverer (e.g. postal worker). All transport damage must also be reported immediately.

10. Retention of title

The ordered goods remain the property of the pfefferspray24.ch. buyitonline.ch is entitled to make a corresponding entry in the retention of title register. Before the transfer of ownership, pledging, transfer of ownership by way of security, processing or modification is not permitted without the express consent of buyitonline.ch.

11. 11th Chemicals Act / Age of majority / Observance of safety instructions

Please always pay attention to the hazard warnings on the packaging or on our website as well as the application and first aid information provided by the manufacturer. If you have any questions, please contact our customer service.

By submitting your order, you confirm that you have reached the legally required minimum age of 18 and that the information you have provided regarding your name and address is correct. You are obliged to ensure that only you or persons authorized by you to accept the delivery who have reached the legally required minimum age receive the goods.

12. Data Protection

The pfefferspray24.ch advises the customer that the data recorded during the conclusion of the contract will be collected, processed and used to fulfill the obligations arising from the purchase contract and may also be used for marketing purposes. The data necessary to fulfill the service may also be passed on to commissioned service partners (logistics partners) or other third parties.

13. Changes and Additions

The pfefferspray24.ch reserves the express right to adapt or change these General Terms and Conditions at any time to suit the circumstances and to apply them immediately.

14. Applicable law and place of jurisdiction

In the event of disputes, only Swiss substantive law shall apply, excluding conflict of law rules. The Vienna Sales Convention is explicitly excluded. The place of jurisdiction for natural and legal persons is Ermatingen.
